Iberian Wine Tours Terms & Conditions
When you make a booking with Iberian Wine Tours Limited, you agree to be bound by the terms and conditions of contract as stated below in this document. Your contract with Iberian Wine Tours (also referred to as ‘us, ‘our’ and ‘we’) is covered by these terms and conditions, the booking form you complete, the payments you make to Iberian Wine Tours and the invoice(s) and confirmation(s) of booking that Iberian Wine Tours sends to you. By accessing and using this website you agree to be bound by the terms and conditions and the jurisdiction stated below. Please note that additional terms and conditions apply to group bookings; these are supplied at the time of booking.
1. Booking
You need to complete a booking form (on the website or as supplied by Iberian Wine Tours) and make the appropriate payment to Iberian Wine Tours for the trip and party that the booking covers (the appropriate payment is the deposit specified on the tour overview on the Iberian Wine Tours website or the full trip payment for late bookings). The lead client on the booking form is responsible for making sure that all payments due from that party are made on time. Once you have received the booking confirmation from Iberian Wine Tours, the booking is complete.
2. Contract and jurisdiction
When you make a booking with Iberian Wine Tours, you accept the terms and conditions stated in this document. The contract is subject to English law (and no other) and to the jurisdiction of the courts of England and Wales, unless you are resident in Northern Ireland or Scotland and choose to resolve any dispute in the courts of Northern Ireland or Scotland.
3. The price
The price of the tour will be confirmed at the time of booking. We reserve the right to correct any errors in published and confirmed prices. In exceptional circumstances we also reserve the right to increase or decrease the price (by between 2% and 10%) in the event of surcharges being payable by us due to changes in government taxes, fuel or duty or exchange rate fluctuations. If the increase in price is over 10%, you will be entitled to a full refund of all payments made to us, if you exercise this right within 14 days of notification of the change in price.
4. Cancellation by you
If you wish to cancel your booking, you need to confirm the cancellation in writing by email or letter. If you contact Iberian Wine Tours prior to confirming your cancellation we can advise you of the cancellation charges applicable to your situation. The cancellation charge is based on the number of days prior to the starting day of the trip booked. The charges are per person cancelling, as follows:
90 days or more – loss of deposit
89-60 days or more – 25%
59-30 days – 50%
29 days or less – 100%
5. Alteration or cancellation of tours by us
From time to time, tours do not reach the minimum number of bookings necessary to make the trip viable. We reserve the right to cancel or alter a tour in these circumstances. If we cancel the tour or make substantial alterations, we will advise you at least 60 days before departure and will offer you alternative dates or a full refund. We reserve the right to make lesser alterations and changes, which will not be deemed a reason for you to cancel. Lesser alterations and changes will be communicated to you in the updated versions of the tour itinerary up to and including the final itinerary before travel. For the avoidance of doubt, substantial alterations include (but are not limited to) changes to tour dates, quality of hotels and changes to the majority of wineries visited. Lesser changes include (but are not limited to) changes to individual winery visits, substitution of a hotel for another of the same standard or small changes to timings of visits.
6. Our liability
We are responsible for the parts of your holiday that you book with us but not for elements booked with 3rd parties (such as flights or extensions not booked through us). We accept our responsibility (including our employees and suppliers) to fulfil all the elements of the tour you book with us to a high standard and with reasonable skill and care. We do not accept responsibility for failure to enjoy your holiday where it is due to anything other than our breach of contract. We are not responsible for injuries that are a result of any member of your party being drunk or through their own actions or inactions, nor are we responsible for any injuries caused by 3rd parties not connected with the tour or any services that are not part of the contract or brochure. We are also not responsible for failure to enjoy your holiday as a result of a specialist request or health condition that you failed to disclose at the time of booking or for any unusual or unforeseeable consequences beyond our or our suppliers control.
We accept responsibility for the arrangements we agree to provide for you as an organiser under the terms of the Package Travel, Package Holidays and Package and Tours regulations 1992. It is a condition of this liability that a claimant notifies us of any claim promptly and in accordance with our complaints procedure.
All the services we provide will be subject to the local laws of the country in which they are provided. Any claim that is for services covered by an international convention will be limited to the maximum compensation specified by the convention.
With the exception of claims arising from injury, illness or death, the maximum limit to any claim against us is 2.5 times the amount paid by the person for the tour in question.
7. Your liability, health and what we expect from you
We expect you to behave in a responsible way and have consideration for others. If you behave in such a way that you cause (or could cause) danger or distress to others or damage to property, we reserve the right to terminate your holiday.
We expect you to be fit and in good condition to enjoy one of our tours. All our tours involve a good amount of walking on different surfaces and we expect you to be able to handle this. If you have any doubt about your ability to participate on the tour, you should consult your doctor and follow their advice and you should also contact us so that we can advise you as to what terrain and activities are dangerous or difficult on the tour in question. We reserve the right to refuse to accept tour participants who have not disclosed a medical or other condition that would severely inhibit their ability to enjoy the tour or would inhibit the enjoyment of other tour participants. We expect all clients to understand the general and specific risks inherent in travel and to undertake our tours with this in mind.
If you have a medical condition that requires specific treatment or dietary or other requirements to be taken into account, we expect to be notified of this prior to then tour so that we can make appropriate arrangements and in some circumstances, advise whether it is possible to join the tour or not.
8. Covid 19 and Force Majeure
We do not accept liability and cannot pay compensation for events outside our control. Such events include (but are not limited to) terrorism, war, natural disasters, epidemics, adverse or inclement weather conditions. Where such events occur we will endeavour to provide an alternative service or alternative date to you but we do reserve the right to make an increased charge to you if the service offered is of greater value to that contracted.
8a. Iberian Wine Tours will not be responsible for the costs caused by disruption of the tour caused by Covid 19,
whether due to general shutdowns or restrictions or contraction of Covid 19 by any travellers on
tour. However, in the event of disruption Iberian Wine Tours staff will assist travellers as best they can in reducing
the effect and cost of the disruption.
8b. Until further notice, we expect travellers to be fully vaccinated against Covid 19 and where not fully vaccinated we require them to sign a Travel Release Form and strongly recommend they have appropriate Travel insurance. We require all travellers to comply with our general and tour Covid protocols. For travellers who fail to comply with these requirements, we reserve the right to refuse and/or terminate their participation on a tour.
9. Financial protection
In accordance with the UK Package Travel & Linked Travel Regulations 2018, Directive (EU) 2015/2302 or the local applicable law in the country of residence of the passenger(s) booking with Iberian Wine Tours Ltd are fully protected for the initial deposit and subsequently the balance of all monies received by us, including repatriation costs and arrangements, arising from cancellation or curtailment of your travel arrangements due to the insolvency of Iberian Wine Tours Ltd
The respective laws accordingly to the country of residence of the passenger(s) usually only requires us to provide cover for Package & Linked Travel Arrangements, there is no requirement for Financial Protection of day trips or single elements, and none is provided unless the local law requires such. If you have questions on this then please contact Iberian Wine Tours Ltd has taken out an insurance provided by International Passenger Protection Ltd (IPP) with Liberty Mutual Insurance Europe SE (LMIE) trading as Liberty Specialty Markets, a member of the Liberty Mutual Insurance Group. LMIE’s registered office: 5-7 rue Leon Laval, L-3372, Leudelange, Grand Duchy of Luxembourg, Registered Number B232280 (Registre de Commerce et des Sociétés). LMIE is a European public limited liability company and is supervised by the Commissariat aux Assurances and licensed by the Luxembourg Minister of Finance as an insurance and reinsurance company. This insurance is only valid for passengers who book and pay directly with/to Iberian Wine Tours Ltd

10. Advertising information and brochure accuracy
The information described on this website, in our brochures and in any other advertising material is correct to the best of our knowledge at time of publication. All the information is given in good faith, but there are times that errors occur and we reserve the right to correct tour details and prices in such circumstances.
11. If you have a complaint
Our customer feedback is consistently excellent but problems do sometimes occur on tours. If you have a complaint or are suffering from an injury or illness during a tour please advise the guide or local representative at the earliest opportunity. We will endeavour to deal with any problems as quickly as possible. Where necessary you should seek medical help at the earliest opportunity and obtain records and medical reports from any doctors you visit. If you wish to make a formal complaint, you should do so within 30 days of the end of the tour.
12. Tour hosts and guides
All tours are led by an expert host and guide. There is usually also a tour manager, although this is at the discretion of Iberian Wine Tours and depends on the number on the tour and the duration.
13. Health, visas and passports
All clients are responsible for ensuring that they have a full and valid 10 year passport before travel and (where appropriate) any required documentation and visas (although we are not responsible for booking flights, some of our tours cross international boundaries). All clients are also responsible for ensuring that they have the appropriate health documentation before departure. In the case of EU citizens, this means a completed and issued European Health Insurance Card. Non EU citizens should have suitable health insurance as part of their travel insurance policy. It is also the client’s responsibility to bring along correct prescriptions and medications where needed and, if necessary, to obtain doctor’s consent to travel in the event of being in poor health.
14. Data protection
To complete your booking (or respond to an enquiry) we need to collect personal data from you for the purposes of offering (including sending information about future tours) and providing our services to you. For these purposes we are a data controller under the Data Protection Act 1998. We will only use your data (and pass it on to suppliers of travel arrangements) for the purposes of offering and providing our services to you and will take full responsibility to ensure that the data is protected securely.
